Sexual Abuse victims can be entitled to substantial compensation from the perpetrator. If the abuse occurred in a workplace or other organization the victim may be entitled to compensation from the abuser’s employer/supervisor. Perpetrators are found in several circumstances:

Criminal prosecutions against these perpetrators do not compensate the victims. Also, criminal proceedings are almost always against the perpetrator only and not the employer or facility that failed to supervise or negligently hired the perpetrator. In order to receive just compensation, victims should hire a civil litigation attorney who specializes in sexual abuse and molestation cases and who can locate all of the responsible parties. Schools, churches and other organizations can be held liable for the sexual abuse of an employee or independent contractor if they failed to adequately screen the perpetrator prior to the hiring or if they failed to adequately supervise the perpetrator.

It is important to consult with an attorney as soon as possible to determine if you can still bring a claim or civil lawsuit. In the case of school districts and other government entities, you may only have 6 months from the date of the sexual abuse to file the appropriate claim against that entity, or else the victim’s claim is forever barred. The fact that a criminal case is pending does not extend this important deadline. On the other hand, for claims against the perpetrator and his/her employer/supervisor (who is not a school district or governmental entity), a victim can bring a claim as late as just before his/her 26th birthday or within three years of the date the victim discovers or reasonably should have discovered that psychological injury or illness occurring after age 18 was caused by the sexual abuse (see California Code of Civil Procedure section 340.1).

If you are a victim of sexual abuse or the parent or guardian of a victim of sexual abuse, it is extremely important to seek counseling or therapy in order to address the trauma and post-traumatic stress syndrome that inevitably results from the abuse. For victims who were abused at a very young age, it is critical that the child be treated as soon as possible, preferably before the child hits the age of puberty when sexual urges begin to develop. If a child’s first or only sexual experience was in the form of sexual abuse, there is a substantial risk that as the child reaches puberty and beyond, he/she will not develop normally and will experience unusual urges and develop an abnormal sense of sexuality than what is appropriate conduct. In some cases, victims of sexual abuse who go untreated develop into sexual perpetrators themselves because these unresolved feelings and trauma were not addressed earlier in their lives. It is therefore extremely important to seek counseling or therapy as soon as possible for the victim. Victims and their parents or guardian can also seek the advice of an attorney specializing in sexual abuse cases for appropriate therapy and treatment for the victim.
