Traumatic Brain Injury (TBI)*

Traumatic Brain Injury can occur during a closed head injury in which there is a rapid acceleration and then deceleration of the brain, for instance during whiplash or shaken baby syndrome. During closed head injuries, there may be no outward signs that the person was injured. Traumatic Brain Injury also exists when a person suffers visible head injuries, like a skull fracture, that result after the person’s head makes contact with an object, for instance during a motorcycle crash or while receiving a blow to the head. Particularly when a person suffers closed head injuries and does not have outward manifestations of the injury, it can be difficult for that individual to prove that he/she suffered a traumatic brain injury. Traumatic Brain Injury injuries can also be very long-lasting. Yet, people often suffer a mild Traumatic Brain Injury but the injury does not show up during routine neurological examinations.

Traumatic Brain Injury can also have physical, behavioral and cognitive effects. Some physical symptoms that may occur are lethargy, headaches, issues with vision, fatigue, and sleeping problems. Behavioral issues may include irritability, mood swings, and lack of inhibition. Cognitive symptoms that could result from a Traumatic Brain Injury include difficulty concentrating or paying attention, memory loss, the inability to plan, and difficulty with understanding speech or speaking. Often, these problems are believed to be connected to depression when in reality they are a result of traumatic brain injuries.

It can often be very difficult for a person who has sustained a Traumatic Brain Injury to recover sufficient damages for the injury. It can be hard to adequately prove one’s long-lasting physical symptoms to a judge or jury’s satisfaction, especially when there are no outward manifestations of the injury or when neurological exams do not detect the injury.

Because of the difficulty that may arise in proving a serious personal injury like Traumatic Brain Injury, it is crucial that injured persons consult an experienced serious personal injury lawyer. Attorneys with experience in serious injury cases will better understand the long-term effects that a client may be suffering and also have a better idea of how to prove the injury to a judge.
